Terms of Service

To use BanksiaStream, you must create an account. By registering, you represent and warrant that:

• You are at least 18 years of age.
• The information you provide is accurate, complete, and current.
• You will maintain the security of your account credentials.

The free tier ("Find Your Voice") requires phone verification via SMS to confirm your identity. This helps us maintain a genuine creator community and prevent abuse.

You own your content. Creators retain full ownership of all audio, transcripts, show notes, and any other content they publish on BanksiaStream.

By publishing content on the Platform, you grant BanksiaStream a limited, non-exclusive license to host, store, distribute, and display your content for the purpose of operating the Platform, including making your podcast available to listeners, generating transcripts, and powering discovery features.

You may delete your content at any time. Upon deletion, BanksiaStream will remove your content from active distribution within a reasonable timeframe.

BanksiaStream is a platform for creators to share their voice. The views, opinions, and statements expressed in podcasts hosted on BanksiaStream are solely those of the individual creators and do not represent, reflect, or imply endorsement by BanksiaStream. BanksiaStream does not review, approve, or endorse any content before publication. Creators are solely responsible for ensuring their content complies with applicable laws and does not infringe on the rights of others.

You may not publish content that:

• Constitutes hate speech, including content that promotes violence or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics.
• Harasses, threatens, or intimidates any individual or group.
• Contains or promotes illegal activity.
• Is spam, including repetitive unsolicited content or deceptive publishing practices.
• Misrepresents AI-generated content as human-created without clear disclosure to listeners.
• Infringes on the intellectual property rights of others.

BanksiaStream reserves the right to remove any content that violates these prohibitions, with or without notice.

Seed System

The Seed system is BanksiaStream's community endorsement mechanism. Seeds represent genuine listener support. You may not:

• Game or manipulate the Seed system through coordinated voting, bot accounts, or any artificial means.
• Create or use bot accounts to inflate Seed counts or listener metrics.
• Offer incentives in exchange for Seeds.

Backstage Rooms

Backstage rooms are collaborative spaces for creators and listeners. All participants in Backstage rooms must treat each other with respect. Harassment, hate speech, and disruptive behaviour are not tolerated and may result in removal from the room or suspension of account privileges.

Paid subscription plans are billed through Stripe. By subscribing, you authorise Stripe to charge your payment method on a recurring basis according to the plan you selected.

• Cancellation: You may cancel your subscription at any time from your account settings. Your plan benefits continue until the end of the current billing period.
• Grace period: If a payment fails, you have a 14-day grace period to update your payment method. During the grace period, your account remains active.
• Refunds: We do not offer refunds for partial billing periods. If you cancel mid-period, you retain access until the period ends.

The BanksiaStream name, logo, and platform code are the intellectual property of BanksiaStream and are protected by applicable intellectual property laws. You may not use the BanksiaStream brand or trademarks without prior written permission.

Creators retain all intellectual property rights in their own content, as described in Section 3.

BanksiaStream may suspend or terminate your account if you violate these Terms. We will make reasonable efforts to notify you before or after suspension.

Upon account termination, your content will be preserved for 30 days. During this period, you may request an export of your data. After 30 days, your content and associated data will be permanently deleted.

You may delete your account at any time from your account settings. Upon deletion, the same 30-day preservation period applies.

To the maximum extent permitted by law, BanksiaStream shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform, including but not limited to loss of data, revenue, or profits.

BanksiaStream does not guarantee uninterrupted or error-free operation of the Platform. Your use of the Platform is at your sole risk.

BanksiaStream may update these Terms from time to time. For material changes, we will provide at least 30 days' notice by email or through a prominent notice on the Platform. Your continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
